Hello,

Please, is there anyone (please, a lawyer!) in the room which can explain why a patent can be hold on a gene not discovered by the patent owner ?

Among the 342 claims, which one could -let's be imaginative...- justify it ?

Many thanks.

Please let me answer the following questions

Is it possible to have blue eyes only on the basis of mother`s genetic?

What type of DNA analysis should be performed to determine which groups of genes affecting eye color in an individual?

It will be interesting to see how this case proceeds. Genetic Technologies has a long history of patent litigation (some might call it patent trolling), including an abortive attempt to enforce Myriad's BRCA patents in Australia, and a disturbingly broad and successful patent on the uses of non-coding DNA.

As I noted in my post on ACTN3 four years ago, this test has extremely limited predictive power, and basically zero utility for most potential athletes. Still, anything that can be used by parents to test the future potential of their kids - however spuriously - has commercial potential, so I can see why GTG is pursuing this.

Also, a quick clarification of my own involvement here: while I'm an author on the 2003 paper reporting the first association between ACTN3 variation and athletic performance, I don't have any commercial interest in the test, and I personally despise GTG's patent-driven approach to biotech. I really hope they lose this case, as expensively as possible.
